Under the Patents Act 1970, any invention that is novel (new), involves an inventive step (non-obvious), and is capable of industrial application is patentable. This includes mechanical devices, chemical compounds, pharmaceutical processes, software with technical application, biotechnology, electronics, and more. Discoveries of natural phenomena, mathematical methods, and business methods alone are not patentable.
A provisional patent application secures your priority date immediately and gives you 12 months to file the complete specification. It's faster and cheaper to file, and lets you use "Patent Pending" — perfect when your invention is still being developed. A complete specification is the full application with detailed claims, description, drawings, and abstract — required for the actual patent grant. Most inventors file provisional first, then complete.
A patent in India is valid for 20 years from the date of filing the complete application (not the provisional). To keep the patent in force for the full 20 years, you must pay annual renewal fees to the Indian Patent Office. If renewal fees are not paid, the patent lapses. Design patents are valid for 10 years, extendable by 5 more years.
Government fees start at ₹1,600 for individuals/startups (80% concession on the standard ₹8,000 fee for online filing). For MSMEs, the fee is ₹4,000. For companies, it's ₹8,000. These are just filing fees — examination and additional claim fees apply separately. Professional drafting and agent fees vary by complexity. Filing can happen within days. Publication occurs 18 months after filing. For examination, you must file a Request for Examination (RFE) — normal examination takes 3–5 years. However, if you opt for Expedited Examination (available to startups, SMSMEs, and others), the process can be completed in 12–24 months.
